Labor subleasing is a conditional business line, so in order to operate, it is necessary to meet the conditions for the issuance of a labor subleasing license.
1. Conditions for issuance of a labor subleasing license
According to the provisions of Article 21 of Decree 145/2020/ND-CP, in order to be granted a labor subleasing license, the following conditions must be met:
a. Conditions for the legal representative of the enterprise performing labor subleasing activities

To be an enterprise manager according to the provisions of the Enterprise Law.

No criminal records.

Having worked directly as a specialist or manager in labor subleasing or labor supply for full 03 years (36 months) or more within 05 consecutive years before applying for a license.
b. Conditions for making escrow
In order to be granted a labor subleasing license, an enterprise needs to meet the conditions that a deposit of 2,000,000,000 VND (Two billion VND) has been made.
2. Legal basis
Decree 145/2020/ND-CP of the Government dated December 14, 2020 detailing and guiding the implementation of a number of articles of the Labor Code on labor conditions and labor relations.
