In case the license is lost, damaged, the enterprise needs to carry out procedures for the re-issuance of employment service license. In case the license expires, it is necessary to renew the employment service license.

1. Re-issuance of employment service license

a. Cases of carrying out procedures for re-issuance of employment service license

The employment service licenses may be re-issued in the following cases:

  • The license is lost.

  • The license is damaged.

  • Change one of the contents in the license.

b. Applications for re-issuance of employment service license

  • A written request for re-issuance of the license of the enterprise. 

  • The license which was damaged.

  • A written certification of the police agency in case of loss of licence. 

  • Documents proving the change of one of the contents in the license.

c. Procedures for re-issuance of employment service license

  • Employment service enterprises submit 01 (set) of complete applications as prescribed by law.

  • Within 5 working days from the day on which the complete application is received, the licensing authority shall re-issue the license to the enterprise.

  • In case of refusal to re-issue, a written reply must be given and state the reason clearly.

2. Renewal of employment service license

Within 30 days before the license expires, the enterprise shall submit an application for license renewal. 

Dossier for renewal of employment service license include: 

- A written request for renewal of the license.

- The original license has expired.

- Documents proving eligibility for issuance of employment service license:

  • Conditions for the location of the enterprise head office or branch:
    • In case the house is owned by the person registering the business, the application for renewal of employment service license must have a valid document of land use right, for example: Certificate of land use right.

    • In case it is a rented house, it must have a lease contract with a lease term of at least 3 years (36 months) and a certificate of land use rights of the current land owner

  • Conditions on deposit and management of deposit:
    • The enterprise must pay a deposit of 300,000,000 VND (Three hundred million dong) at the commercial bank where the enterprise opens its main transaction account.

    • Enterprises carry out deposit payment procedures in accordance with the bank's regulations and the law.

Each extension must not exceed 60 months.

Within 15 days from the date of receipt (01 set) of dossier as prescribed, competent state agencies issue an employment service license. In case of refusal to renew, a written reply must be given and state the reason clearly.
