Marriage registration with foreigners is more popular when our country is in the process of integration and development. Therefore, Siglaw would like to provide service on marriage procedures with a foreigner consultancy.

Conditions for registering a marriage with a foreigner

Couples wishing to register their marriage with foreign elements should register at the competent agency. At the same time, the following conditions must be satisfied:

The man is full 20 years of age or older, the woman is full 18 years of age or older.
The marriage is decided voluntarily by the man and the woman.
Both have no loss of civil act capacity.
The marriage does not fall into one of the following cases in which marriage is prohibited:
- Sham marriage or sham divorce.
- Underage marriage, forcing a person into marriage, deceiving a person into marriage, obstructing marriage.
- A married person getting married to or cohabitating as husband and wife with another person, or an unmarried person getting married to or cohabitating as husband and wife with a married person.
- Getting married or cohabiting as husband and wife between people of the same direct blood line; relatives within three generations; adoptive parent and adopted child; or former adoptive parent and adopted child, father-in-law and daughter-in-law, mother-in-law and son-in-law, or stepparent and stepchild.

Procedures for registering a marriage with a foreigner

Processing time: 15 working days from the date of receipt of complete and valid dossiers.
A dossier includes:
- Passports or citizen identification cards or other papers with photos and personal information issued by a competent authority, valid for use to prove identity of Vietnamese citizens.
- Proof of residence to determine the marriage registration authority (during the transition period).

Note:

When registering for marriage, both men and women must be present at the headquarters of the People's Committee. Civil status officers shall guide the male and female to check the contents of the marriage certificate and the marriage registration book, if both of them find the content correct and consistent with the marriage registration dossier, the civil status officer with both men and women to sign in the Book; Both men and women sign in the Marriage Certificate.
In case one or both men and women cannot be present to receive the marriage certificate, at their written request, the Justice Office shall extend the time limit for granting the marriage certificate but not exceeding 60 days from the date the Chairman of the district-level People's Committee signs the marriage certificate.
After 60 days, if both parties do not come to receive the certificate, the Chairman of the district-level People's Committee shall cancel the signed marriage certificate. If the two parties still want to get married after that, they must carry out the marriage registration procedure from the beginning.
