Social insurance is a guarantee to replace or partially compensate an employee's income when his/her income is reduced or lost due to illness, maternity, work accident, occupational disease, or end of working age or death, on the basis of contributions to the social insurance fund.
Types of social insurance
According to social insurance law, there are 2 types of social insurance as follows:

Compulsory social insurance: A type of social insurance organized by the State that employees and employers must participate in.

Voluntary social insurance: A type of social insurance organized by the State in which participants can choose a payment level and payment method suitable to their income and the State has a policy to support insurance premiums. social insurance for participants to enjoy pension and death regime.
Subjects eligible for social insurance
The following subjects are eligible for social insurance:

Employees who are Vietnamese citizens are eligible to participate in compulsory social insurance.

Employees who are foreign citizens who come to work in Vietnam with a work permit or a practice certificate or a practice license issued by a competent Vietnamese agency are entitled to participate in compulsory social insurance according to the Governmental regulations.

Employers participating in compulsory social insurance include state agencies, non-business units and people's armed forces units; political organizations, socio-political organizations, socio-political-professional organizations, socio-professional organizations, other social organizations; foreign agencies, organizations and international organizations operating in the Vietnamese territory; enterprises, cooperatives, individual business households, cooperative groups, other organizations and individuals that hire and use labor under labor contracts.

Participants of voluntary social insurance are Vietnamese citizens from the age of 15 years or older and are not subject to compulsory insurance.
Legal basis for social insurance

Decree No. 143/2018/ND-CP guiding the Law on Social Insurance and the Law on Occupational Safety and Health on compulsory social insurance for foreign employees working in Vietnam.

Decree No. 33/2016/ND-CP guiding the Law on Social Insurance on compulsory social insurance for soldiers, people's police and cipher workers receiving salary as military personnel.

Decree No. 30/2016/ND-CP detailing investment activities from social insurance, health insurance and unemployment insurance funds.

Decree No. 134/2015/ND-CP guiding the Law on Social Insurance on voluntary social insurance.

Decree No. 115/2015/ND-CP guiding the Law on Social Insurance on compulsory social insurance.
