Temporary Residence Card is a required document of foreign workers to be able to live and work in Vietnam.

However, in recent years, due to the illegal residence and working of many foreigners in Vietnam, state agencies have taken measures to strictly control the issuance of Temporary Residence Cards for foreigners. Therefore, many enterprises have encountered difficulties in the process of carrying out the procedures for granting the above type of documents to employees at their units.

Conditions for the issuance of temporary residence card for foreign workers

Foreigners are issued a Temporary Residence Card when meeting the following conditions:

The employee's passport is valid for 13 months or more.
The migrant worker uses the correct visa.
The employee has been issued a Work Permit or Confirmed that the foreign worker is exempt from a Work Permit.
Foreigners who have completed the procedures for temporary residence registration at the ward/commune-level police office.

Procedures for the issuance of temporary residence cards to foreign workers

Procedures for granting temporary residence cards are as follows:

Implementation profile:
- A written request for a temporary residence card (Form NA6).
- The application form for temporary residence card for foreigners (Form NA8).
- A document introducing the seal and signature of an authorized person of the organization (Form NA16).
- A certified true copy of the Work Permit/Confirmation that the foreign worker is not eligible for a Work Permit.
- Original passport of the employee.
- 2 photos of 2cm x 3cm size of the employee (color photo, white background, bare head, not wearing colored glasses).
- Confirmation of temporary residence declaration of foreigners.

Decree 152/2020/ND-CP on foreign workers working in Vietnam and recruiting and managing Vietnamese employees working for foreign organizations and individuals in Vietnam.
Law on entry, exit, transit and residence of foreigners in Vietnam dated June 16, 2014.
Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Vietnam dated November 25, 2019.
