Work Permit is a required document for foreign workers to be able to live and work in Vietnam.

However, in recent years, due to the illegal residence and working of many foreigners in Vietnam, state agencies have taken measures to strictly control the issuance of Work Permit for foreigners. Therefore, many enterprises have encountered difficulties in the process of carrying out the procedures for granting the above type of documents to employees at their units.

Conditions for the issuance of a work permit

In order to work in Vietnam, foreign workers need to be issued a work permit, and a work permit is only issued when the following conditions are met:

Have a full civil act capacity.
Have suitable health for the job requirements.
Being a manager, executive director, expert or technical worker.
Not being a criminal or being examined for penal liability in accordance with Vietnamese and foreign laws.
Get the written approval of the competent state agency on the employment of foreign workers.

Procedure for the issuance of a work permit

The issuance of a work permit is carried out in the following order:

Step 1. Register the need to use foreign workers:

At least 30 days before the expected date of the employment of foreign workers, the employer needs to register the need to employ foreign workers.

Estimated implementation time: 10 business days.
Application for implementation: A written explanation of the need to employ foreign workers.

Step 2. Apply for a Work Permit:

At least 15 business days before the date the foreign worker is expected to start working for the employer, that employer must submit an application for a work permit.

Estimated implementation time: 05 working days.
Implementation profile:
- An application form for certification of exemption from work permit No. 11/PLI Appendix I hereto appended.
- A fitness to work certificate issued by a foreign or Vietnamese competent health facility issued within 12 months before the submission date of the application or the certificate as specified in regulations of the Minister of Health.
- A police (clearance) certificate or a document certifying that the foreign worker is not serving a sentence, has a criminal record expunged or is not facing a criminal prosecution issued by a foreign or Vietnamese authority.
  The foregoing police (clearance) certificate or document certifying that the foreign worker is not serving a sentence, has a criminal record expunged or is not facing a criminal prosecution issued within 6 months before the submission date of the application.
- Proofs as a manager, executive, expert, technical and certain jobs.
- 02 color photos (size 4cm x 6cm, white background, straight face, bare head, not wearing colored glasses), photos taken within 06 months from the date of application submission.
- A certified true copy of your passport or a valid document in lieu of your passport or a valid international travel document.

Legal basis

Labor Code 2014.
Decree 152/2020/ND-CP on foreign workers working in Vietnam and recruiting and managing Vietnamese employees working for foreign organizations and individuals in Vietnam.
Law on entry, exit, transit and residence of foreigners in Vietnam dated June 16, 2014.
Law amending and supplementing a number of articles of the Law on entry, exit, transit and residence of foreigners in Vietnam dated November 25, 2019.
