Trading in chemicals is a conditional business that needs to be closely monitored and managed. Those who want to participate in this industry need to satisfy the conditions prescribed by the state and the law.

Conditions for chemical traders

1. The concept of chemical trading

Pursuant to Clause 2, Article 3 of Decree 113/2017/ND-CP stipulating:

“Chemical trading” includes sale, export and import of chemicals to provide chemicals on the market for profitable purposes.

2. Conditions for chemical traders

According to the provisions of Clause 2, Article 9 of Decree 113/2017/ND-CP and Clause 1, Article 9 of Decree 17/2020/ND-CP, conditions for chemical traders include:

Physical and technical facilities: 

  • The applicant is an enterprise, cooperative or household business that is established in accordance with regulations of law and licensed to trade in chemicals.

  • The applicant’s facilities meet trading requirements specified: Workshops, warehouses and technological equipment; Safety equipment, fire and explosion prevention and fighting, lightning protection, prevention and control of chemical leakage and dispersion and other chemical incidents; Labor protection equipment; Equipment for environmental protection, waste treatment system; Transportation; Table of regulations on chemical safety.

  • Area and location of the warehouse meet national technical regulations and standards.

  • The chemical store or premises satisfy requirements for chemical and fire safety.

  • Chemical containers and packages ensure the quality and environmental safety; vehicles transporting chemicals shall comply with regulations of law.

  • The warehouse or the agreement on lease of warehouse or use of the warehouse of the chemical buyer or seller satisfies requirements for chemical and fire safety.

  • Any person responsible for chemical safety of the chemical store has at least an intermediate school’s degree in chemicals.

  • The individuals must be provided with training courses in chemical safety, including: Heads of units, production and business establishments, and affiliated departments and branches; in charge of production, sales and technical departments; workshop manager or equivalent; The deputy head of the head assigned to be in charge of chemical safety; Full-time and part-time staff in charge of chemical safety of the establishment; Persons directly supervising chemical safety at the workplace; workers directly involved in chemicals.
