A certificate of eligibility for production or trade in industrial chemicals is an activity of applying for a document that a state agency provides to an eligible enterprise or establishment as prescribed by law. So, how to apply for this type of certificate?
Procedures for a certificate of eligibility for production or trade in industrial chemicals
1. Conditions of chemical production facilities
Establishments want to produce chemicals need to meet several conditions specified in Clause 1, Article 9 of Decree 113/2017/ND-CP:
First, the applicant is an enterprise, cooperative or household business that is established in accordance with regulations of law and licensed to produce chemicals.
Second, the physical and technical facilities must meet requirements such as:

Technical equipment shall satisfy general requirements for safety in accordance with national technical regulations and standards.

Hazardous chemicals shall be classified and stored according to the nature of each chemical substance.

Chemicals in the warehouse shall be stored according to national technical regulations and standards to ensure safety and facilitate response to chemical emergencies.
Third, the location and area of the warehouse shall satisfy general requirements in accordance with national technical regulations and standards.
Fourth, the chemical store or premises satisfies requirements for chemical and fire safety.
Fifth, chemical containers and packages ensure the quality and environmental safety; vehicles transporting chemicals shall comply with regulations of law.
Sixth, the warehouse or the agreement on lease of warehouse or use of the warehouse of the chemical buyer or seller satisfies requirements for chemical and fire safety.
Seventh, any person responsible for chemical safety of the chemical store has at least an intermediate school’s degree in chemicals.
Eighth, the individuals mentioned in Article 32 herein have been provided with training courses in chemical safety.
2. Procedures for applying a certificate of eligibility for production or trade in industrial chemicals
Step 1: The organization or individual applying for the Certificate shall make 01 dossier and send it by post or directly or through the online public service system to the Department of Industry and Trade where the chemical production or trade is carried out.
Step 2: In case the dossier is incomplete and invalid, within 03 business days from the date of receiving the dossier, the certificate-issuing agency shall notify the organization or individual to supplement and complete the dossier. The time to complete the dossier is not included in the time of issuing the Certificate.
Step 3: Within 12 business days from the date of receipt of complete and valid dossiers, the certificate-issuing agency is responsible for considering, appraising and granting the Certificate of eligibility to organizations, individuals, co-operatives and individuals and send 01 copy to the Department of Industry and Trade where the organization or individual's head office is registered.
3. Implementation period
12 business days, excluding the time to amend and supplement the dossier to be valid.
