The law stipulates the conditions for preschool educational activities, including:
1. Having a license to establish a private preschool issued by the District People's Committee.
2. There are qualified teachers according to regulations.
3. Having a room for safe rearing, care and education of children; the area of the child rearing, care and education room must be at least 1.5 m2 for one child; have play areas, fences and gates to protect children's safety; places where children's meals are organized must have their own, safe kitchens; ensure fire and explosion prevention and food hygiene and safety. There is enough clean water for domestic use and enough daily drinking water for children.
4. Equipment for an independent group of children:

Minimum equipment for children includes: Activity and play mattresses or carpets, nap beds, blankets, pillows, mosquito nets, drinking water containers, toy storage racks, child towel racks and cup holders, infant potty chairs and teacher's chairs.

Documents for child raisers, including: instructional kits for child care and education activities; child progress monitoring record-books; record-books for monitoring of assets of the nursery group; materials used for promotion of parents’ knowledge about child care and education.
5. Equipment for an independent kindergarten class:

Minimum equipment for children includes: Desks and chairs meeting stipulated standards for children, especially those under 5 years: Sets of one desk and two chairs for two children; one desk, one chair and one whiteboard for teachers; shelves for storage of supplies and toys; drinking and tap water tanks.
For the semi-boarding class: There must be wooden sleeping boards or beds, blankets, pillows, mosquito nets and fans for children’s naps.

Documents for kindergarten teachers include: instructional kits for child care and education activities; child progress monitoring record-books; materials used for promotion of parents’ knowledge about child care and education.
6. For places where the network of preschool educational institutions has not yet met the needs of sending children to school and classes, individuals can organize groups of children to meet the needs of parents to nurture and care for children and must register its operation with the Commune People's Committee, ensuring the following conditions for operation registration:

The maximum number of children in the group is 07 children.

Child carers who are healthy, have full capacity for civil responsibility and have certificates of professional training in child care and nurturing as prescribed.

Facilities must satisfy the following minimum conditions: Child rearing and care rooms have an area of at least 15 m2; ensure safety, ventilation and coolness; have safe, age-appropriate toys for children; have enough utensils and equipment for child rearing and care; have enough drinking water and daily living water for children; have restrooms and sanitary equipment suitable for children; have documents guiding the implementation of child care and education.
