To establish a preschool, it is necessary to follow the procedures prescribed by law. So, what is the procedure for establishing a preschool?
Procedures for establishing a preschool
1. Conditions before the establishment of a preschool
Before going into the establishment of a preschool, investors need to pay attention to the following 4 basic conditions:

Having land, infrastructure and equipment meeting the requirements of maintaining and developing educational activities.

Having a team of managers, teachers and staff sufficient in quantity, reasonable in structure and qualified to ensure the implementation of the preschool education program and the organization of educational activities.

Having sufficient financial resources as prescribed to ensure the maintenance and development of educational activities.
-
There are regulations on organization and operation of preschools.
2. Procedures for establishing a preschool
To establish a preschool, clients need to complete two procedures, which are to apply for a decision to establish a preschool and apply for a license to operate educational activities as follows:
a. Apply for a decision to establish a preschool
Step 1: Prepare the applications for the decision to establish a preschool. Applications include:

Proposal for the establishment of a preschool.
-
The project to establish a preschool.
-
A document on lease of house and land or a document on land allocation for the construction of the head office for the establishment of a preschool with a term of at least 5 years.
-
The draft master plan of the site and preliminary design of architectural works built on the land.
Step 2: Submit the applications at the District People's Committee, the district where the head office is located
Within 20 working days from the date of receipt of a complete and valid applications, the District People's Committee will command the Education and Training Department and relevant specialized departments to give appraisal opinion of the applications and factual appraisal of conditions for establishing preschools and kindergartens according to the prescribed contents and conditions.
Within 15 working days from the date of receiving the written appraisal opinion of the Department of Education and Training and relevant specialized departments, if the preschools meet the conditions under regulations, the chairman of the District People's Committee shall issue a decision to establish or permit the establishment; If the preschools do not meet the conditions as prescribed, the Chairman of the District People's Committee shall reply in writing and state the reason clearly.
b. Apply for a license to operate educational activities
After having been granted a decision to establish a preschool, you need to apply for a license to operate educational activities.
Step 3: Prepare the applications for applying for a license to operate educational activities. Applications includes:

A written request for permission for educational activities.

The decision to establish a preschool.
-
Detailed report on the implementation of the school establishment investment project.
-
A list of teachers, clearly stating their professional qualifications; a working contract has been signed between the preschool and each teacher.

A list of officers holding key leadership positions, including the principal, vice principals, heads of specialized departments, divisions and groups, clearly stating their trained professional qualifications; the working contract has been signed between the preschool.

Preschool education program, documents serving the implementation of the preschool education program.
-
A list of the number of classrooms, working rooms, facilities and equipment meeting the prescribed conditions.

Legal document certifying the land use right or the contract to rent the land.
-
Legal documents confirming the amount of available money of the preschool.
-
Regulations on organization and operation, regulations on internal expenditures of preschools.
Step 4: Submit your application at the Department of Education and Training where the school is located
The Department of Education and Training will receive and organize the assessment of the application. If your application is not in accordance with the regulations, the Department of Education and Training will notify in writing about the contents that need to be corrected and supplemented to the preschool within 05 working days from the date of receipt of the application; if the application is in accordance with regulations, notify the factual assessment plan at the preschool.
Within 20 working days from the date of notification of the actual assessment plan, the Department of Education and Training will preside and coordinate with relevant specialized departments in organizing the actual assessment at the preschool.
Within 10 working days, if the preschool meets the prescribed conditions, the Head of Education and Training Department will issue a decision to allow educational activities; if the prescribed conditions are not satisfied, the preschool shall be notified in writing and state the reason clearly.
Note: Before proceeding with Step 3 to apply for an educational operation license, your preschool needs to have a Principal and vice Principal to run the preschool. After appointing these positions, preschools need to carry out additional procedures to apply for a decision to recognize the Principal and vice Principal of the preschool at the District Department of Education and Training.
