The procedure for the suspension of business

1. Notification procedure for the suspension of business

According to Article 206.1 of the Law on Enterprises 2020, enterprises shall send a written notification to the business registration authority at least 03 working days before the suspension date or resumption of business before the notified deadline.

Business suspension

Pursuant to Clause 1, Article 66 of Decree No. 01/2021/ND-CP, in case an enterprise requires to continue to suspend business after the notified suspension period, they must notify at least 03 working days before the planned date of suspension

Note: In case a household business suspends their business for 30 days or less, they are not required to implement notification procedure with the business registration Office.

2. Implement procedure:

The notification of business suspension shall be implemented as follows:

• For enterprises, branches, representative offices and business locations

Place of application: Business Registration Office of the Department of Planning and Investment where the enterprise's head office is located.

• For household businesses 

Place of application: Department of Finance and Planning under the People's Committee of the district where the household businesses are headquartered.
